TERMS OF SALES

 

  1. Object

These general conditions are applicable to all orders placed by the customer via our website with BRUME de Longueville and to all our sales and service contracts. They are also applicable to any user of the site www.brumedelongueville.be.

Unless proven otherwise, the customer acknowledges having read these general conditions of sale.

The acquisition of a good or a service through this site implies unreserved acceptance by the purchaser of these conditions of sale.

BRUME de Longueville / the seller reserves the right to modify its conditions of sale at any time. The applicable conditions will be those in force on the date of the order by the buyer.

  1. Tradename

 

The sale of our products is carried out under the trade name of BRUME de Longueville on behalf of Gersende VAN ERP domiciled at 8 rue de la Station, 1325 Longueville   - Belgium, registered with the Banque Carrefour des Entreprises under number 0566 899 375. Any contact can be made via the contact form on this site, via the address  info@brumedelongueville.be  or via the aforementioned address.

 

  1. Products and services

The products and services offered are those listed in the catalog published on the seller's website. The sale can only be considered concluded as soon as the customer receives confirmation from us of the acceptance of his order and full payment of the sums due. Each product is accompanied by a description established by the supplier and / or seller.

The photographs, texts and illustrations presenting the products are provided for information only and do not constitute contractual documents. These are as faithful as possible but cannot guarantee a perfect similarity with the product presented, in particular as regards the colors and certain details in the materials such as for example the designs in a semi-precious stone which are by essence unique and BRUME de Longueville cannot therefore be held liable in one way or another in the event of a slight variation.

Any order of products   is subject to the limit of available stocks. In the event of a supply difficulty or out of stock, the seller informs the buyer by email as soon as possible and offers him the possibility of ordering other replacement products or of waiting until the product is possibly again from stock. The buyer if he prefers can also   cancel the order of unavailable items free of charge, we will then refund the amount paid. 

The available items will be delivered.

 

  1. Price and payment

Product prices are those displayed on the site in euros, VAT and other applicable taxes included, excluding delivery costs. In the event of a manifest error in the price, we reserve the right to inform the buyer, who can then confirm the continuation of his purchase at the rectified and correct price or cancel his order. In no case will we be required to provide and accept the conclusion of the sale if it is obvious that the advertised price is incorrect and that the customer could realize it and this despite sending a confirmation of ordered.

The seller reserves the right to modify its prices at any time. However, the prices applicable to the order are those in force at the time of confirmation thereof. The prices indicated do not include transport or delivery costs.

Unless otherwise stipulated, payment is made when placing the order by debit, Visa, Mastercard, Bancontact or PayPal credit card. The order will only be taken into account after payment has been accepted.

BRUME de Longueville presupposes in good faith that the buyer has the necessary authorizations to make a payment via secure payment systems. BRUME de Longueville may suspend the management of any order or delivery in the event of a payment problem confirmed by the financial organizations or in the event of non-payment. BRUME de Longueville disclaims all liability related to malicious or fraudulent use of one of the means of payment offered on its site.

The items ordered remain our exclusive property until full payment of the order by the buyer.

Regarding the sale of unique or made-to-measure pieces, unless otherwise specified, a deposit of 50% of the total value of the order will be requested.  This deposit will not be returned in the event of cancellation of the order, to cover the costs incurred such as the purchase of the material necessary for the realization of this one, the creation, the manufacturing costs, etc.

 

  1. Rights and obligations of the buyer

The buyer, who wishes to buy a product must complete the identification form on which he will indicate all the requested details, after verifying these, he will validate his order online by following the different steps of the process indicated and make the payment. under the conditions provided.

The confirmation of the order entails the acceptance of these conditions of sale, the recognition of having read them and the renunciation to take advantage of its own conditions of purchase or other conditions.

All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.

The seller will communicate by e-mail the confirmation of the recorded order.

In accordance with the law, the buyer has a   right of withdrawal which must be notified to the seller within 14 calendar days from the day after the day of delivery of the product. This notification without penalty and without giving any reason must be sent by e-mail to the address  info@brumedelongueville.be . The delivered product must also be returned by the buyer at his own expense and risk, to the head office of BRUME in Longueville (  8 rue de la Station, 1325 - Longueville) within this 14-day period. This right of cancellation does not belong to the professional buyer.

The product must be returned in its original packaging, undamaged, unworn, unused in any way and accompanied by all its accessories, as well as the invoice and the original delivery slip.

Incomplete, damaged, damaged or soiled goods by the customer will not be taken back or refunded.

Within 30 days, after acceptance of the return of the goods, the seller undertakes to reimburse any payment, with the exception of shipping costs.

Unless otherwise agreed, the customer cannot exercise the right of renunciation for contracts for the supply of products made according to the customer's specific request or personalized.

 

  1. Delivery

Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. The customer is required to verify the accuracy of the information he provides for the delivery details. In the event of any data entry errors, BRUME de Longueville cannot be held responsible for the consequences thereof. Any additional costs in the processing of the order resulting from these errors will be entirely the responsibility of the customer.

The goods are transported at the risk of the seller until delivery of the goods to the delivery address specified by the buyer. From that moment, the buyer or any other person taking delivery of the delivery assumes the risks alone. Delivery times are only indicative; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

 

  1. Force Majeure

The occurrence of any event, such as in particular any interruption of production, transport or delivery, strike, lockout, embargo, war, terrorist attack or consequence of an attack, insufficient raw material, epidemic, bad weather and more generally all events of similar nature affecting the parties or their suppliers and delaying or making impossible the execution of their respective obligations, suspend the execution of their respective obligations.

The party invoking such an event will notify the other party as soon as possible of proof of its occurrence.

The performance of its obligations will be suspended until notification of the end of the event, it being understood that neither party can claim any compensation from the other party.

The parties will do their utmost to reduce the difficulties and / or the damage caused.

If the force majeure lasts more than 60 days, the parties will make every effort to renegotiate the subsequent performance of the contract.

Failing agreement, each party will have the right to terminate it by notification addressed to the other party.

 

  1. Guarantees

In accordance with European Directive 1999 // 44 / EC, the seller guarantees the products he sells and the services he provides.

In the event of non-conformity of a product sold noted within 2 months of delivery of the goods, the consumer must notify the seller as quickly as possible in a precise manner by registered letter or e-mail to the address info @ brumedelongueville .be.

This warranty only covers any lack of conformity existing at the time of delivery of the goods. It is understood that the finding of this lack of conformity must take into account the particular nature of the product and that the customer must take care of the latter.   

Defects or damage due to improper use of the product by the customer are not covered by the warranty. The customer is therefore required to avoid putting the product in contact with water, detergents or abrasive products, impacting or dropping it, and showing negligence. 

Normal wear and a certain patina associated with the wearing of our products cannot be considered as a lack of conformity within the meaning of this provision.

Likewise, repairs carried out by persons other than the seller will void the warranty.

The invoice or the delivery slip serve as a guarantee and must be kept by the customer.

 

  1. Intellectual property rights

All elements of our website are and remain the intellectual and exclusive property of it. Any single link or hyperlink is strictly prohibited without the prior express written consent of the seller.

No one is authorized to reproduce, use, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether visual or sound.

 

  1. Nullity

The nullity or inapplicability of one of the clauses of these general conditions cannot affect the validity or the applicability of the other clauses.

Where applicable, the parties undertake to replace the null or inapplicable clause by a valid clause which is the closest from an economic point of view to the null or inapplicable clause.

The fact that the seller does not avail himself of these general conditions of sale at a given time, cannot be interpreted as a waiver to avail himself of them subsequently.

Any communication and notification between parties will be validly effected by registered letter, fax, e-mail with acknowledgment of receipt, for the seller at its registered office and for the purchaser at its registered office or domicile.

 

  1. Responsibilities

 

BRUME de Longueville only contracts obligations of means, for all stages of access to the site, from order to delivery, or subsequent services. It cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or any fact that may be qualified as force majeure. In any event, BRUME de Longueville's liability under these General Conditions may not exceed an amount equal to the sums paid or payable during the transaction giving rise to said liability, whatever the cause or form of the liability. action concerned.

 

 

  1. Protection of personal data

All personal data necessary for processing an order are kept by the seller or his collaborators and can be transmitted to companies with which the seller - or his suppliers - collaborate (s), when such communication is necessary for the processing of the order. ordered.

These conditions of online sale are subject to Belgian law.

In the event of a dispute, the courts of the jurisdiction of Nivelles (Belgium) are competent, except for binding public order provisions.
